Terms and Conditions
These terms and conditions apply to all appointment bookings placed by the client with Upaya Wellbeing, at www.upaya.com.au. Please read our Terms and Conditions carefully before accepting any appointment booking at www.upaya.com.au By placing a booking, you enter into an agreement with us and accept these Terms and Conditions. We may modify the Terms and Conditions from time to time. Any changes made after you have made an appointment booking will not affect your booking unless we are required to make the change by law.
We recommend that you download our Terms and Conditions to keep a copy for your reference.
The term ‘Upaya Wellbeing’ or ‘us’ or ‘we’ refers to the owner of the website and physical clinic at 709A Darling Street, Rozelle, NSW, 2039, Johan Denecke ABN: 12489063364. The term ‘you’ refers to the user or viewer of our website or visitor to our clinic.
The terms ‘practitioner’ or ‘practitioners’ refers to practitioners who practice and accept bookings on upaya.com.au at the clinic or through online consultation.
These Terms and Conditions and all disputes arising in connection with these Terms and Conditions or with the use of the website or with any bookings on the website shall be governed by Australian law. Upaya Wellbeing may modify or amend these Terms and Conditions at any moment. You are therefore asked to accept only the Terms and Conditions applicable at the time of purchase with each of your orders.
By completing a booking you agree to understand that Upaya Wellbeing accepts and processes bookings on behalf of practitioners. Upaya Wellbeing, and with that, www.upaya.com.au functions as an intermediate between you and the practitioner. Specific Term & Conditions related to practitioner services offered by a practitioner will be communicated with you by the practitioner.
Upaya Wellbeing is legally not responsible for any of the services and outcomes of these services provided by practising practitioners. Any disputes or concerns related to practitioner services are to be handled directly with the practitioner. We only accept practitioners who have relevant certifications and credentials related to their service and who are up-to-date and in the possession of First Aid Certificates and relevant insurances. By accepting the Terms & Conditions you agree that Upaya Wellbeing is in no way responsible for the safekeeping of personal belongings while you are at the clinic.
Rescheduling or cancelling of client
On behalf of the practitioner, we only accept cancellation of appointment no later than 48 hours prior to your appointment start time unless agreed upon differently with your practitioner. Cancellation or reschedule options will be communicated to you by your practitioner or can be done via email (email@example.com). Should you fail to attend your appointment or fail to give 48 hours notice, it is your practitioners right to fully charge you the fees.
Rescheduling or cancelling of practitioner and/or Upaya Wellbeing
Occasionally, unforeseen events arise and your practitioner needs to cancel your appointment. If your appointment is cancelled due of an unforeseeable events beyond our control, including but not limited to temporary illness of a practitioner, then you reserve the right to either reschedule the appointment or cancel and refund all monies paid.
We comply to and update COVID-19 safe measurements to prevent and control COVID-19 as directed by the Australian Government and Department of Health. If you have been directly or indirectly exposed to COVID-19 or suffer from any of the COVID-19 symptoms you are to contact your practitioner right away to cancel or move your appointment.
The personal details that we collect during your booking are directly provided to your practitioner and will not be shared with any other third party. We reserve the right to contact you once after your appointment with a practitioner. This is to ask you to provide us with any feedback or experiences relating to your appointment. Your details will only be added into our database for Upaya Wellbeing information subscription if you have given us permission either through the booking, the website, or your practitioner.
